2. MyCertify Services
This site makes available food handler training and certification as well as TABC training and certification. You, as the user, must procure your own equipment such as a computer and Internet access to gain access to our services.
MyCertify reserves the right to modify or discontinue the site at any time without notice to its users. We will not be held liable to you or any third party should we exercise said right. Features that improve the user experience may be added to the site and be subjected to the Terms and Conditions of Use.

Your account as user cannot be used to breach the security of another account or network. Users who are proven to violate account or network security may be subjected to criminal or civil liability.
We have the right to remove your account from our database and terminate your use of the site in case it is proven that you have violated any of the above provisions. You also acknowledge that we will use the full power of the law to investigate possible criminal violations that transpire through this site.

An appeal is a formal request for reconsideration of an adverse decision made by a MyCertify Advisory Group or its representatives related to an individual’s achievement of a certificate.
An appeal must be made in writing to the Supervisor within thirty (30) days of receiving the determination being appealed. The written appeal must include the stated appeal, the reason for the appeal (including relevant supporting materials), and appellant's contact information.
All appeals and dispositions shall be recorded in the Appeals Register, which shall be maintained by MyCertify.
Individuals with concerns regarding the assessments, personnel, or other elements of the certificate program are encouraged to discuss these with the individuals involved to try to resolve the matter informally. In some cases, however, informal resolution is not possible, and individuals may wish to file a formal complaint.
A complaint shall be submitted in writing to the Supervisor within ninety (90) days of the incident’s occurrence. In the case of complaints related to a course or assessment administration, those must be submitted in writing within 2 weeks after the applicable course/assessment administration. The submission may be mailed, e-mailed or faxed. The submission shall include sufficient objective evidence to substantiate the claims and allow for a decision to be made and the appropriate action to be taken. Dissatisfaction based on hearsay shall not be considered as a complaint. Anonymous complaints shall not be considered.
9. Disclaimer of Warranties
This site does not provide any warranty that (A) your expectations or requirements will be met as a user, (B) that its services will not be interrupted, be without delay, or is error-free, and (C) that the results from using its services are effective or reliable.
This site may contain technical mistakes or inaccuracies. We may make changes to the materials and content at our own discretion. The materials, contents, and services found on this site may be outdated. We make no commitment in claiming that our site is up to date.
We are not in any way liable should you or any third party suffer from special, incidental, indirect, or consequential damage due to the use of our site. We shall not be liable as well for any third party goods and services offered through this site.

The terms and conditions found on this Terms and Conditions of Use constitute the entire agreement between Genix, LLC and you, the user. This agreement may not be altered or amended through any other document. The Terms and Conditions will also take precedence should anything associated with this site be found inconsistent to this agreement. Any course of action brought by you against us has to be instituted within one year after the cause transpires or be deemed forever waived and barred.
